Minutes of Zoning Board of Appeals Public Meeting

William Nicholson called the meeting to order at 7:05 p.m. and gave an overview of the hearing process.

Public Hearings:

7:07 pm  #08-08  Crockett, 145 Holbrook Ave., Map 20, Parcel 132:  Application for a Special Permit to raise roof in order to permit the raising of the ceilings and also of the  height of dwelling due to new foundation.  Trevor Pontbriand recused himself as an abutter.  The Board consisted of William Nicholson, Robert Hankey, Don Palladino, Manny Heyliger, and Roger Putnam.  Tim Dickey, representing the applicant, stated that originally there was going to be a partial basement, but the project evolved into a full foundation because of sill rot.  Currently the house is right at grade and the foundation will raise it a foot.  There will be some increase of volume within the front setback which will be invisible.  The ridges will be tied together which will raise the ceilings in the dwelling.  The Board recommended Dickey go to the Historical Review Board.  Paul Murphy, Building Inspector, stated there was no Historical Board at the time the original permit was issued for the work and it would be a courtesy to go to them.  William Nicholson moved for Findings of Fact:

1.      This is a pre-existing, nonconforming structure due to the intrusion into the front             setback.
2.      The existing structure exceeds the height limit by approximately 6 feet.
3.      The volumetric increase in this historical building is diminutive.
4.      The structure was built in 1880 according to the Assessor’s office.
Roger Putnam moved to approve the Findings of Fact; seconded by Don Palladino; passed 5-0. William Nicholson moved to grant the Special Permit based on the Findings of Fact with a condition; seconded Robert Hankey, passed 5-0.
1.      The applicant is to receive approval by the Historical Review Committee.

Other Business

At 7:20, Trevor Pontbriand moved the Board go into Executive Session to discuss the impending litigation for Case # 08-05.  POLL:  William Nicholson yes; Robert Hankey no; Don Palladino yes; Roger Putnam no; Manny Heyliger no; and Trevor Pontbriand yes.  Vote failed.    
After further discussion, it was determined Christine Bates will send an e-mail to the Board to determine when a meeting can be scheduled for all members of the Board to be present for a meeting.  

William Nicholson moved to adjourn the meeting at 7:35 pm; seconded by Don Palladino; passed 6-0.
